Enigmatic Martin

This is an "old" book - published in 1970 and now long since out of print. It is also one of the very best in illuminating one of the Framers of the constitution and in explaining the proceedings of the Convention of 1787. Even if your interest is less in Martin than in the counter-opinions of those subsequently called anti-federalists - this book is an excellent read. And, if you think of Mr. Jefferson as saintly - this perspective will tilt his halo a bit with the, seldom told, other side of the story in its well documented accounts of the Cresap and Chase and Burr controversies.
The co-authors Paul S. Clarkson & R. Samuel Jett are (or were?) Baltimore attorneys: they probe the life of the provocative Luther Martin (also an attorney) as lawyers would. Martin's childhood and youth fly past quickly - there is little of real interest for the legal focus. When finally Martin is accepted to the Bar - the story takes on intensity, sometimes testing for the lay reader, for the occasional definition of the "odd" legal term, or the reread of abstruse legal text.
The authors lapse occasionally into (what seems?) hyperbole when it comes to pride for their own state: "The General Court of his period was probably the greatest trial court in the history of the American judiciary" (pg. 59) and "Under the Maryland constitution of 1776 the senate was probably the most ultraconservative body of legislative Bourbons in American history" (pg. 68). And while examination of legal outcomes - sometimes even proceedings - is the vehicle for presenting Martin's accomplishments, philosophies & attitudes, the vehicle is by no means off-putting or obtuse to the lay reader... it works.
The chapters dealing with the Constitutional Convention of 1787 are simply the BEST that I have ever read, even including Amar's masterful America's Constitution: A Biography. They are written in advocacy of Luther Martin and the role that he played. They are nonetheless compelling if not convincing that historians have given short shrift to one of the most incisive members of that delegation. A motion put before the constitutional convention by Luther Martin became the supremacy clause within the constitution (Art. VI, � 2). In its final form it moved so far beyond Martin's intentions that he later disclaimed it in a 1788 letter to Oliver Elsworth. Nonetheless - Martin - the archetype Anti-Federelist - as "father" of the supremacy clause is high irony! The chapters (22-24) on Martin's defense of Aaron Burr at the infamous treason trial are detailed and vividly told. The selection of the jury, testimony of the witnesses and presentation of evidence (such as it was) are masterfully presented. All this generating acquittal against a force of contemporaneous popular opinion that is shown to be hugely stacked against Burr.
Luther Martin is minimized in modern historical accounts as a drunkard and "prolix" in his presentation. He may well have been, but the record is stacked with Mr. Madison's perspective and that of the "winners", the Federalists - no friends of Mr. Martin. (He did later become a "Federalist" - though largely in reaction to Jefferson's Democratic-Republican party.) This book is serious history, it requires the reader's attention. Sometimes it moves on feet of clay for its legalistic inspection, but even with that said, chapters 7-16 (the convention) are a 5-star account. The read will leave you with doubts about the eccentric Luther Martin's vices and will not fail to stimulate your interest in his virtues!
